Palm Coast, FL – Flagler County Deputy Sheriff Kyle Gaddie was in a struggle with a suspect that he was trying to handcuff when two Good Samaritans stopped to help.

The incident occurred on Tuesday morning, October 3, during a traffic stop along Old Kings Road North near Frontier Drive, according to The Daytona Beach News-Journal.

During the traffic stop, Deputy Gaddie ordered the driver, Morgan Byrnes, age 27, out of his vehicle after he smelled marijuana.

Deputy Gaddie attempted to remove a pocketknife from Byrnes’ pocket, but Byrnes wouldn’t let him.

In his arrest report, Deputy Gaddie noted that Byrnes refused to follow orders to put his hands behind his back 12 times.

Bodycam video shows Byrnes denying that he had drugs in his car, and demanding a K9 respond to search his vehicle. Of course, a K9 isn’t needed when the officer can smell the drugs.

In the video, Byrnes cited his understanding of the law, which was incorrect. The deputy tried to explain to Byrnes that he already had probable cause, but Byrnes wouldn’t listen.

Byrnes told Deputy Gaddie “I am resisting arrest for an illegal search and seizure.  You are illegally searching and seizing me; I do not have anything in my car. Let me go! I didn’t do anything.”

Two men who were driving by the traffic stop on Old Kings Road saw Deputy Gaddie struggling with Byrnes, and stopped to help.

One of the Good Samaritans, later identified as firefighter Leonardo Chumaceiro, was driving from his assigned fire station on Old Kings Road.  He made a U-turn, and drove back to help.

He said, “The deputy had him kind of under control, he was trying to put the cuffs on, and he (Byrnes) was just jumping and screaming and stuff.  I just grabbed one arm and pinned him down to the trunk of his car and the other guy did the same thing. And the deputy, at that time, he was able to cuff him.”

Chumaceiro said, “In my mind, I think most people that could would’ve done that.  Being in the fire service, I’m working alongside the deputies. Those guys always help me; they help me do CPRs. So there’s no difference. We have to take care of each other.”

Deputy Gaddie searched Byrnes’ car after he was handcuffed and taken into custody, and found a plastic baggie containing about five grams of marijuana in a center console.

When he found the marijuana, Deputy Gaddie said “I knew it.”  He turned back to Byrnes and said, “All that for a little weed?”

Byrnes was charged with resisting arrest with violence, battery on a law enforcement officer, and possession of marijuana. He was booked into jail Tuesday and released on bail later Tuesday afternoon.

Flagler County Sheriff Rick Staly thanked both men for their help.

    How many times does an LEO have to tell someone to put their hands behind their back before taking further action, ie: taser etc.? It is amazing how many people think they do not have to comply with a lawful order.       Jonas, this is called a well trained and experienced police officer, doing his job as he was trained too do, as most officers do. The small percentage of officers that you are referring to and the product of what society has caused. The good, properly selected officers that should have the job, no longer want it because they are smart enough to know that they can loose their job and future due to people with opinions like yours that ALL cops are bad and racist. So what you end up with is what is being hired today and have been for a while. People that want to be cops for all the wrong reasons. People that are not qualified but are selected, because that was all there is too choose from. People that do not multitask well, people that are not physically or mentally able to deal with hot situations and when scared, go for the gun instead had hands on dealing and acting as they were trained. Society reaps what it sows. You demonize ALL cops and the good ones are smart enough to move one. So you end up with a few good new officers working with a bunch of people that were only selected because that was all there was too choose from. Bad in, bad out. I have seen video after video being posted of officers literally backing away from the bad guys. Afraid to go hands on and make the arrest. Or using a taser and when that fails, they have no clue what to do next. And before everyone starts blasting me for my uneducated opinion, yes, it is my opinion, but backed up with the fact that I spend the last 17 years, before I retired, hiring and training new police officers. When you teach at the academy and grown men and women can not do a single push up during DT, what kind of upper body strength do you think they have to handle some big guy like the one in this video. That is the situation where they freak and shoot, whether the suspect is black or white. But those people are passed on through the academy because agencies are so desperate for bodies, because the academy has done away with physical fitness requirements to pass. People see the here and now, cause and effect. They don’t see the big picture of what their actions do to law enforcement as a whole, plays out years from now. So unless you have that much experience on the subject…………..

On a side note, I worked the West Side of our town, in patrol, during the Rodney King era. It was an area that was 98% black. I was a well trained, level headed officers. When I would get out with people, they would immediately become hostile, but again, being well trained and level headed, as I spoke of in my SPEECH, I was able to talk to these people and work things out, even if that meant taking them to jail. Amazingly, working for almost 10 years in a predominantly black area, I managed to do so without shooting or killing a single black person. As did the rest of the white cops I worked with. And guess what, the statistics from then are the same as they are now in regards to minorities killed by cops. So as I tried to explain in my speech, different times, but it all comes back to, bad in, bad out. And until good applicants are ready to return to law enforcement, it will continue. But again, I am wasting my breath, as you have already made up your mind about ALL COPS.
